A familiar question is coming up in IT departments: “We purchased Microsoft 365 Copilot licenses for some employees, but almost everyone has a Copilot app. Are employees without a paid license getting the same data protection?”
Employees can receive enterprise data protection without a paid Copilot add-on. They must use the business Copilot experience with their company work account. That protection is an important starting point, but organizations still need to decide what information employees may use and which features they will allow.
Which Copilot Are Your Employees Using?
“Free Copilot” is an imprecise description. It can refer to business Copilot Chat available with an eligible Microsoft 365 subscription, or to consumer Copilot used with a personal account.
Those experiences have different terms.

The business enterprise commitments do not apply |
Microsoft is updating its branding: Microsoft 365 Copilot Chat is now called Microsoft Copilot Chat, and some documentation refers to Microsoft 365 Copilot as Microsoft Copilot. Older names may remain in applications and licensing materials during the transition. The naming changes do not change the enterprise protection commitments.
For IT teams, the important question is which account and service are handling the conversation.
What Does Enterprise Data Protection Include?
Microsoft’s business Copilot offerings share core contractual commitments, including:
- Encryption in transit and at rest, and isolation between tenants.
- Coverage under Microsoft’s commercial Data Protection Addendum and Product Terms.
- A commitment that prompts, responses, and Microsoft Graph data are not used to train foundation models.
- Support for applicable permissions, administrative settings, and compliance controls.
The specific controls available depend on the organization’s subscriptions and configuration. A paid Copilot license should not be assumed to provide every retention, auditing, or data-loss-prevention capability an organization needs.
Enterprise protection also does not mean conversations are never stored. Microsoft documents that work-account Copilot Chat interactions are logged and can be reviewed through supported administrative tools. “Not used for model training” and “not retained” are different commitments.
Check the Session, Not Just the Workstation
A Copilot icon on a managed computer does not establish that the employee is using an enterprise-protected session. Signing into Windows with a company account is not enough on its own.
Have IT check the application or browser experience employees use and the account active inside Copilot. Employees should know how to recognize their company account before entering business information.
A useful starting point is Copilot for work, accessed with the company’s Microsoft Entra account. Organizations should also decide whether personal-account Copilot use is permitted on managed devices.
What Does the Paid License Add?
Paid Microsoft 365 Copilot provides broader access to organizational information, deeper application capabilities, and additional management and analytics features.
The distinction is more nuanced than “free chat versus paid Office integration.” Depending on the subscription and experience, users without a paid add-on may already have limited in-app capabilities. They can also provide work content through uploads or supported open-document contexts.
The paid offering can draw more broadly on work information through Microsoft Graph, subject to the user’s permissions. That is valuable, but it makes existing sharing practices more consequential. A file shared too widely may become easier to discover through Copilot.
For that reason, we recommend reviewing permissions and oversharing alongside licensing. Choose paid licenses around specific tasks such as preparing meeting summaries or finding information across work content and measure whether those capabilities help the employees receiving them.
Web Search and Agents Need Their Own Review
Two features deserve attention before approving sensitive use.
Web search: Copilot can generate short search queries from a prompt and send them to Bing. Microsoft removes user and tenant identifiers and makes additional confidentiality commitments, but these queries have different terms from the prompt and response. The Data Protection Addendum does not apply to generated web-search queries. Administrators can manage web-search availability.
Agents: Review each agent’s permissions, data sources, privacy terms, and billing arrangement. Some agent use is metered. Access to Copilot Chat at no additional cost does not mean every feature available through it is free.
For confidential or regulated work, evaluate those details against your requirements rather than treating enterprise data protection as blanket approval.
A Practical Approach to Copilot Adoption
We recommend starting with four decisions:
- Define the approved experience. Identify how employees should access Copilot and require company-account sign-in.
- Set clear information-handling rules. Explain what employees may enter, upload, or share, including client information.
- Verify controls and billing. Confirm the settings, compliance capabilities, agents, and consumption charges that apply.
- Assign paid licenses where they help. Start with concrete business tasks, review results, and adjust assignments as adoption develops.
